Common Questions About Injury Cases
How much does a personal injury lawyer cost?
Nothing up front. We work on contingency, which means our fee is a share of what we recover for you. The consultation is free. If we do not win your case, you owe us nothing. You will never get a bill from us out of pocket. This is how most personal injury lawyers in New York work, and it means anyone can afford to hire us — not just people with money saved up.
How much is my case worth?
It depends on your injuries, your medical bills, your lost wages, and how the accident has changed your life. No honest lawyer can promise you a number at the start — be careful with anyone who does. What we can promise is this: we will investigate your case fully, add up every cost the accident has caused you, and fight for every dollar the law allows.
How long will my case take?
Some cases settle in months. Others take longer, especially if your injuries are serious or the insurance company fights back. A lot depends on your medical treatment — we usually wait until doctors know how badly you are hurt, so we do not settle for less than your case is worth. We do not rush you into a low offer just to close a file. We keep you updated at every step, and we move as fast as a fair result allows.
Will I have to go to court?
Most personal injury cases settle without a trial. We investigate, handle the paperwork, and negotiate with the insurance company. If the insurer refuses to pay fairly, we are ready to file a lawsuit and litigate. Either way, we handle everything — the forms, the phone calls, the court dates — so you can focus on healing. Many of our clients never set foot in a courtroom.
What if the accident was partly my fault?
You may still have a case. New York uses a rule called comparative negligence. It means you can recover money even if you were partly to blame — your recovery is just reduced by your share of the fault. Do not decide on your own that you have no case. Call us and let us look at the facts.
What is no-fault insurance?
In New York, your own car insurance pays your medical bills and part of your lost wages after a car accident — no matter who caused it. That is the no-fault system. But no-fault does not pay for pain and suffering. For serious injuries, you may also have a claim against the driver who hurt you. We handle both.
What should I do right after an accident?
First, get medical help — your health comes first, and medical records also protect your case. If you can, take photos of the scene and your injuries, get the names of witnesses, and report the accident to the police or the property owner. Do not give a recorded statement to the insurance company before talking to a lawyer. Then call us — it is free.
How long do I have to file a claim?
Deadlines in New York are strict. For most personal injury cases, you have 3 years from the accident. But if the City or another government agency is involved, you may have only 90 days to file a Notice of Claim. And a no-fault application usually must be filed within 30 days of a car accident, or you can lose those benefits. Miss a deadline, and even a strong case can be thrown out. The safest move is to call a lawyer right away — it costs nothing to ask.
I am in the hospital and cannot travel. Can you still help me?
Yes. We visit clients at home and in the hospital — we have done it for years. If you can travel but have no ride, we can arrange car service for your first consultation. Being hurt should never stop you from getting legal help.
Do you speak my language?
Yes. Our staff speaks English, Spanish, Bengali, Greek, and Albanian. You can tell us what happened in your own words, in your own language, and we will keep you informed the same way through your whole case.
