What to Do If a Car Hits You

  • Call 911 and make sure the police come and write a report. If the driver fled, report it to the police within 24 hours — this protects your right to a hit-and-run claim.
  • Get medical care the same day, even if you think you are okay. Head and internal injuries can hide at first.
  • If you can, get the driver's name, insurance, and plate number — and photos of the car, the crosswalk, and the signal.
  • Ask anyone who saw it for their name and phone number.
  • Do not accept cash at the scene and do not tell the driver or any insurance adjuster "I'm fine."
  • Keep every hospital paper, receipt, and missed-work record.

Your Rights as a Pedestrian in New York

You have the right of way in the crosswalk. New York law requires drivers to yield to people in a crosswalk — including drivers who are turning. A green light for the driver is not permission to drive through people who are still crossing. When a driver fails to yield, that is negligence.

You do not need a car or insurance of your own. This surprises almost everyone: in New York, a pedestrian hit by a car is covered by the driver's no-fault insurance. That policy pays your medical bills and part of your lost wages — up to $50,000 — even if you have never owned a car and have no insurance at all. You do not have to prove the crash was the driver's fault to get these benefits. But the claim generally must be filed within 30 days, so call quickly.

Hit-and-run victims can still recover — through MVAIC. Many people think that if the driver got away, the case is over. It is not. New York created the Motor Vehicle Accident Indemnification Corporation, or MVAIC — a special fund that pays people hurt by hit-and-run or uninsured drivers. It can cover medical bills, lost wages, and compensation for your injuries. The catch is the deadlines: the crash must be reported to police within 24 hours, and the MVAIC claim must be filed quickly. Most people have never heard of MVAIC. The big deadlines. Beyond no-fault, a lawsuit against the driver for serious injuries generally must be filed within 3 years, and a wrongful death case within 2 years. Even if you were partly at fault — say you crossed mid-block — New York law still lets you recover; your share of fault just reduces the amount.
