Hurt in a Car Crash in the Bronx? You Are Not Alone
The Bronx has some of the busiest and most dangerous roads in New York City. The Cross Bronx Expressway is famous for being one of the most jammed highways in the country. The Bruckner Expressway carries heavy truck traffic day and night. The Grand Concourse is wide, fast, and hard to cross. Add double-parked cars, delivery vans, and drivers who run red lights, and it is no surprise that thousands of our neighbors are hurt in car accidents every year.
What comes after the crash can feel just as hard as the crash itself. Many drivers on Bronx streets carry no insurance at all. Some hit a car and drive away. The insurance companies call fast, ask confusing questions, and try to pay as little as they can. Meanwhile the medical bills pile up, your car sits damaged, and you may be too hurt to work. It is a lot to carry — and you should not carry it alone.
The Law Offices of Evan W. Kohn has stood up for injured people in the Bronx for more than 35 years. Evan Kohn was born and raised here — from the Bronx, for the Bronx. Our office is at 2000 White Plains Road, right under the elevated 2/5 train. The consultation is free, and there is no fee unless we win your case. If you are too hurt to travel, we come to your home or hospital, and we can even arrange car service for your first visit.
Car Accident Cases We Handle
Auto accident lawyers see the same crashes again and again on Bronx roads. If your crash is on this list — or even if it is not — call us and we will tell you honestly if you have a case.
Rear-End Crashes
Stop-and-go traffic on the Cross Bronx and the Bruckner leads to rear-end hits every day. Whiplash, back injuries, and neck injuries are real — even when the car damage looks small.
Intersection & Left-Turn Crashes
Busy corners on the Grand Concourse, Fordham Road, and Tremont Avenue see cars turning across traffic. When a driver fails to yield, the people in the other car often get hurt the worst.
Hit-and-Run Accidents
In the Bronx, drivers leave the scene far too often. Even if the driver is never found, you may still have a claim through your own policy or a special state fund. Do not give up before you talk to us.
Drunk & Distracted Drivers
A driver who was texting, speeding, or drinking put you in the hospital. We gather the police report, phone records, and witness accounts to show exactly what the driver did wrong.
Uninsured Driver Crashes
Many drivers here have no insurance or fake insurance cards. That does not mean your case is over. Your own policy may have coverage you did not know about — we find it and use it for you.
Injured Passengers
If you were a passenger, you almost never share the blame. You can bring a claim no matter which driver caused the crash — even a family member or friend. Their insurance pays, not them.
How it works
What We Do for You, Step by Step
From your first free call, we take the pressure off you. Here is what car crash lawyers at our office actually do on your case.
-
01
We investigate the crash
We get the police report, photos, camera footage, and witness statements. We move fast, because skid marks fade and videos get erased.
-
02
We handle the no-fault and insurance paperwork
New York's no-fault forms have strict deadlines — miss one and your medical bills may not be covered. We file everything on time so your treatment and lost wages get paid.
-
03
We build your case
We collect your medical records, talk with your doctors, and add up everything the crash has cost you — bills, lost pay, and the pain you live with every day.
-
04
We negotiate — and litigate if we must
We deal with the insurance company so you never have to. Most cases settle. If the insurer will not pay a fair amount, we take your case to court.
After the Crash
What to Do After a Car Accident
- Call 911. Ask for police and an ambulance, even if you think you are okay.
- See a doctor right away. Some injuries — like neck, back, and head injuries — show up days later.
- Take photos of the cars, the street, your injuries, and any traffic signs or lights.
- Get the other driver's name, license, plate number, and insurance card. Get witness names and phone numbers too.
- If the driver fled, report the hit-and-run to the police within 24 hours. This protects your right to recover money.
- Do not give a recorded statement to the other driver's insurance company. You do not have to talk to them.
- Keep every bill, receipt, and doctor's note. Write down the days you miss work.
- Call us at (718) 409-5500 before you sign anything. The consultation is free, 24/7.
New York Car Accident Law, in Plain English
No-fault insurance pays first. New York is a no-fault state. That means after a crash, your own car insurance — or the insurance for the car you were in — pays your medical bills and part of your lost wages, up to $50,000. This is called Personal Injury Protection, or PIP. It pays no matter who caused the crash. But there is a catch: you must file the no-fault application within 30 days of the accident. Miss that deadline and the insurance company can refuse to pay your bills. This is one of the first things we handle for every client.
The serious injury threshold. No-fault covers bills, but it pays nothing for your pain and suffering. To sue the at-fault driver for that, New York law says your injury must be "serious" — for example, a broken bone, a significant loss of use of a body part, or an injury that keeps you from your normal daily activities for at least 90 of the first 180 days. Insurance companies love to argue an injury is not serious. We know how to prove that it is, with medical records and doctors' findings.
Your deadline to sue. In most New York car accident cases, you have 3 years from the date of the crash to file a lawsuit. Some cases have much shorter deadlines — claims against the City or a government agency require notice within just 90 days. The safest move is simple: talk to a lawyer early, even if you are not sure you want to sue.
Hit-and-run and uninsured drivers. If the driver fled or had no insurance, you may still recover money through the uninsured motorist coverage on your own policy, or through MVAIC — a New York fund created for exactly this situation. These claims have their own strict deadlines, which is why reporting the crash to police quickly matters so much.
Crashes involving trucks, Ubers and taxis, or motorcycles, bicycles and e-bikes follow extra rules. If you were on foot when a car hit you, see our pedestrian accident page — no-fault covers you there too.
