A New Kind of Crash, an Old Kind of Insurance Fight

Electric scooters arrived on Bronx streets faster than the insurance industry decided what to do about them. Under New York rules a standing e-scooter is not a motor vehicle: it needs no license, no registration and no insurance. What that means for the injured rider is genuinely unsettled — insurers frequently take the position that a scooter rider is outside the no-fault system, and that position gets contested case by case. Nobody should be told the answer over the phone by the company that would have to pay it.

The part that is not unsettled is the claim against whoever caused the crash. A driver who turns without yielding, opens a door, or runs a light is responsible for the injuries that follow, and a rider standing on a scooter is no more at fault for being there than a pedestrian is for being in a crosswalk. Where the roadway itself caused the fall — a pothole, a sunken utility cut, an unsecured steel plate — there may instead be a claim against the City or the utility, and those carry much shorter deadlines.

Scooter injuries skew toward the upper body, because a rider standing upright goes over the handlebars rather than sideways. Wrist and forearm fractures, dislocated shoulders, facial and dental injuries and concussions are the pattern. Those are exactly the injuries that look minor on an intake form and change a person's year. Document them early and treat them properly; that record is what your claim is built on.

The Law Offices of Evan W. Kohn has handled injury cases in the Bronx for more than 35 years, in English and Spanish, from an office at 2000 White Plains Road. The consultation is free and there is no fee unless we win.

E-Scooter Cases We Handle

Cars Turning Across the Lane

The most common scooter crash there is. A driver crosses the bike lane at a corner and never yields to something moving faster than a bicycle looks like it should.

Dooring

A scooter rider hit by an opening door goes over the front. The duty to check before opening sits with the driver or passenger.

Potholes and Road Defects

Small wheels and a broken road are a bad combination. Claims against the City turn on prior written notice of the defect, so timing matters enormously.

Rented and Shared Scooters

If the scooter was rented, the rental terms, the maintenance records and the condition of the machine all become part of the case.

Brake, Battery and Frame Failures

A scooter that fails underneath you is a product case. Keep the scooter — it is the evidence — and do not send it back before we look.

Hit-and-Run

When the driver leaves, there may still be a route to a claim. It has its own short deadlines and it will not start itself.

What To Do

After an E-Scooter Crash

  • Call 911 and get a police report made at the scene.
  • Be examined the same day. Wrist, shoulder and head injuries are routinely missed when adrenaline is still up.
  • Photograph the vehicle and plate, the scooter, the road surface, the lane and your injuries.
  • If the road caused the fall, photograph the defect with something for scale, and note the exact corner.
  • Keep the scooter, or if it was rented, record the vehicle number and keep the ride receipt.
  • Call before giving any recorded statement. The first call from an adjuster is not a courtesy.

Questions Scooter Riders Ask

Do I need a license or insurance to ride an e-scooter in the city?
No. New York City rules require no driver's license, no registration and no insurance for a standing e-scooter. The citywide speed limit is 15 mph, riding on the sidewalk is not allowed, and helmets are required for riders aged 16 and 17.
Will the driver's no-fault insurance pay my medical bills?
That is exactly the contested question. Insurers often say a scooter rider is not a covered person; that position is argued case by case and can turn on the facts. Do not treat a denial letter as the last word — bring it in.
I fell because of a pothole, not a car. Do I have a case?
Possibly, and the clock is much shorter. Claims involving the City generally require written notice within 90 days, and they turn on whether the City already had written notice of that specific defect. Call the same week if you can.
I was not wearing a helmet. Does that end it?
No. Comparative fault reduces a recovery to the extent your own conduct contributed; it does not extinguish the claim.
The scooter was a rental. Who is responsible?
It depends on what failed and why. If the machine was defective or poorly maintained, the company behind it may be in the case alongside any driver involved. Keep the ride record.
