Truck Crashes Are a Bronx Problem
The Cross Bronx Expressway is one of the most congested truck corridors in America. Every day, thousands of 18-wheelers squeeze through it on their way to New England, New Jersey, and Long Island. Thousands more roll in and out of the Hunts Point Market, one of the largest food distribution hubs in the world. And on our residential streets, box trucks and delivery vans double-park, back up, and turn where children play and neighbors walk.
A loaded tractor-trailer can weigh 80,000 pounds. A car weighs about 4,000. So when a truck hits a car, a bike, or a person, the injuries are rarely minor. Broken bones. Head injuries. Back and neck damage. Sometimes worse. Families are left with hospital bills, missed paychecks, and an insurance company that will not call back. Meanwhile, the trucking company's own investigators may already be at the scene, working to protect the company.
The Law Offices of Evan W. Kohn has stood up for injured Bronx residents for more than 35 years, from our office at 2000 White Plains Road, right under the elevated train. Evan Kohn was born and raised in this borough. From the Bronx, for the Bronx. The consultation is free, and you pay no fee unless we win. If you were hurt in a car instead of by a truck, see our Bronx car accident lawyer page.
Truck Accident Cases We Handle
If any kind of commercial truck hurt you or someone you love, we can help. As a New York City truck accident lawyer team, we handle:
18-Wheeler & Tractor-Trailer Crashes
Fully loaded semis on the Cross Bronx, the Bruckner, and the Major Deegan cause the most violent crashes on our roads. These cases involve federal safety rules and large insurance policies — and they need a lawyer who knows both.
Box Truck & Delivery Truck Accidents
Amazon vans, FedEx and UPS trucks, and food-supply box trucks race through Bronx streets all day. Drivers on tight schedules cut corners. When they hit someone, the delivery company often shares the blame.
Garbage Truck Accidents
Private sanitation trucks run through the Bronx at all hours, often moving fast with huge blind spots. Garbage truck crashes cause terrible injuries to drivers, cyclists, and people on foot.
Commercial Van Accidents
Contractor vans, utility vans, and work trucks are everywhere in the Bronx. When the driver was on the job, the company that put that van on the road can be held responsible too.
Blind-Spot & Turning Crashes
Big trucks cannot see cars, bikes, or people right beside them. A truck that turns or changes lanes without looking can crush whatever is in its blind spot. The law still calls that negligence.
Cargo & Brake Failures
Overloaded trailers, cargo that shifts, and worn-out brakes cause crashes before the driver even touches the wheel. Maintenance and loading records tell the story — if your lawyer gets them in time.
How it works
What We Do on a Truck Accident Case
Trucking companies have lawyers and investigators working within hours of a crash. You should too. Here is how we work:
-
01
We investigate right away
We send the trucking company a legal letter ordering it to preserve the driver's logs, the truck's black-box data, camera footage, and inspection records — before any of it can disappear.
-
02
We handle the insurance paperwork
We file your no-fault forms on time so your medical bills and lost wages start getting paid. We deal with the adjusters so you never have to talk to them.
-
03
We build your case
We dig into the driver's hours, the company's hiring and maintenance records, and every federal safety rule that was broken. When needed, we bring in crash experts and doctors.
-
04
We negotiate — and litigate if we must
Most cases settle. But if the trucking company's insurer will not pay what is fair, we take the case to court and keep fighting.
After the Crash
What to Do After a Truck Accident
- Call 911. Ask for the police and an ambulance, and make sure a police report gets made.
- Get medical care right away, even if you feel okay. Some serious injuries show up days later.
- If you can, photograph the truck, the company name on the door, the license plate, and the DOT number.
- Get the names and phone numbers of any witnesses.
- Do not give a statement to the trucking company's insurance adjuster, and do not sign anything they send you.
- Save everything — hospital papers, receipts, and the police report number.
- Call a truck accident lawyer quickly. Trucking evidence can be erased or destroyed within weeks.
Why Truck Cases Are Different Under the Law
Federal rules apply. Trucking companies and their drivers must follow rules set by the FMCSA — the Federal Motor Carrier Safety Administration. Those rules limit how many hours a driver can drive, require regular truck inspections, and require drug and alcohol testing. When a company breaks those rules, that is powerful proof of negligence. A regular car accident case has none of this.
The evidence disappears fast. Federal law only requires companies to keep driver logs for about six months. Dashcam and warehouse footage can be recorded over in days. The truck itself can be repaired and put back on the road. That is why we investigate immediately and send preservation letters that make destroying evidence a legal problem for the company.
More than the driver may be responsible. The company that hired the driver, the company that owns the trailer, the crew that loaded the cargo, and the shop that skipped a brake repair can all share the blame. Finding every responsible company matters, because commercial trucks carry much bigger insurance policies than cars — and those insurers fight hard to keep their money.
New York deadlines are strict. A no-fault application generally must be filed within 30 days of the crash. Most truck injury lawsuits must be filed within 3 years, and a wrongful death case within 2 years. The sooner you call, the more evidence we can save. We are available 24/7 at (718) 409-5500.
