Here is what many people do not know: property owners in New York have a legal duty to keep their buildings, stores, and walkways safe. That includes your landlord, NYCHA, the supermarket, and in most cases the owner of the building next to the sidewalk where you fell. When they ignore a broken stair, a wet floor, bad lighting, or ice that sat for days, and someone gets hurt, the law calls that premises liability. It means they can be held responsible. Property owners must keep you safe. Under New York premises liability law, owners and managers must fix dangers they know about, or should have known about, within a reasonable time. A puddle that appeared one minute ago is one thing. A broken stair the whole building complained about for months is another. Proving what the owner knew is the heart of a fall case, and it is exactly what we dig up.

The 90-day deadline for city and NYCHA cases. This one is critical. If you fell on city property, or in a NYCHA building, or anywhere the City of New York or a public agency is responsible, you must file a formal Notice of Claim within 90 days of the fall. That is about three months. Not three years. Miss that deadline and you can lose your right to any money at all, no matter how badly you were hurt. Many people in the Bronx live in NYCHA housing and do not know this rule. If there is any chance the City or NYCHA is involved in your fall, call us now, not later.

Sidewalks: who owns them matters. In New York City, the owner of the building next to the sidewalk is usually responsible for keeping it safe, not the City. But there are exceptions, like many one-, two-, and three-family homes where the owner lives there, where the City may be responsible instead. And if the City is responsible, that 90-day Notice of Claim deadline applies. Sorting out the right party is not your job. It is ours.

Other deadlines. For most falls on private property, New York gives you three years from the date of the fall to file a lawsuit. If a loved one died from a fall, the family generally has two years to bring a wrongful death case. Cases against NYCHA or the City must be filed even sooner.
