Do Not Accept the Denial Letter

When a car hits a delivery rider on an electric bike in the Bronx, the insurance company's first move is usually to say the rider is not covered. Sometimes it says so in a letter. Sometimes it just stops answering. Riders read that as the end of the matter — and it is not.

Here is the honest state of the law. Under New York rules, an e-bike is not a "motor vehicle": it needs no license, no registration and no insurance of its own. That has two consequences. It means the rider cannot be blamed for having no policy. It also means that whether the striking driver's no-fault insurance has to pay the rider's medical bills is a genuinely open question — insurers deny it, riders and their lawyers contest it, and there is no settled appellate answer that applies to every class of e-bike. Anyone who tells you flatly that you are covered, or flatly that you are not, is guessing.

What is not in doubt is the claim against the driver who hit you. A driver who turns without looking, opens a door into the lane or runs a light is responsible for the harm, and that claim does not depend on what you were riding or on your immigration status. Neither does your right to be treated at a hospital.

If you were making a delivery when it happened, there may be more than one claim: against the driver, and potentially connected to the work itself, depending on how you were engaged and by whom. Bring us whatever you have — the app screen, the order, the dispatch messages, the photo you took at the corner — and we will look at all of it for free.

E-Bike Cases We Handle

Most e-bike injuries in the Bronx come from the same short list of driver mistakes — and from streets that were never built for the number of riders on them now.

Turning Cars and Right Hooks

A car crosses the bike lane at the corner without yielding. At delivery speed there is no room to stop and nothing between you and the vehicle.

Dooring

A door opens into the lane on Westchester Avenue or the Concourse. The duty to look before opening sits with the person opening the door.

Blocked and Disappearing Bike Lanes

Double-parked trucks push you into moving traffic. The vehicle that blocked the lane can share responsibility for what happens next.

Hit-and-Run

Drivers leave delivery riders in the road far too often. Even with no plate number there may be a route to a claim, but it has to be started quickly.

Battery Fires and Defective Equipment

A lithium battery that ignites while charging or riding is a product case, not a traffic case. Keep the battery, the charger and the receipts if you safely can.

Injured While Working a Delivery

How you were engaged when you were hit can open a second avenue on top of the injury claim. Bring us the app records and let us look.

What To Do

After an E-Bike Crash

  • Call 911 and ask for a police report, even if the driver wants to settle it on the street.
  • Go to a hospital the same day. Emergency care does not depend on insurance or immigration status.
  • Photograph the car and plate, the bike, the lane, the door, and your injuries before anything moves.
  • Screenshot the delivery app: the order, the time, the route. It proves what you were doing and what you lost.
  • Keep the bike and the battery. Do not scrap them — they are the evidence in a defect claim.
  • Bring us any denial letter you receive. A denial is a position, not a ruling.

The City Rules Insurers Will Ask You About

Expect the other side to go through the rulebook looking for something to put on you. It is worth knowing what it actually says. In New York City an e-bike needs no driver's license, no registration and no insurance. Class 1, Class 2 and Class 3 e-bikes are all allowed in the city. Since the city set a citywide cap, the speed limit for e-bikes and e-scooters is 15 mph, below the 20 and 25 mph the classes themselves can reach. Riding on the sidewalk is not allowed. Helmets are recommended for everyone and required for workers.

None of these turns a crash into your fault. New York uses comparative fault: if a rule you broke contributed to the injury, it reduces what you recover — it does not close the claim. We would rather you hear that from us than from the adjuster who wants a recorded statement.

Questions Riders Ask Us

The insurance company says an e-bike is not covered by no-fault. Is that true?
It is their position, and it is contested. Because an e-bike is not a motor vehicle under New York rules, whether the striking vehicle's no-fault benefits reach the rider is unsettled, and it can turn on the class of bike and the facts of the crash. It is not something to concede in a phone call. Send us the letter.
Can I bring a claim if I am undocumented?
Yes. Your right to be compensated for an injury caused by someone else's carelessness does not depend on your immigration status, and we do not ask about it to take your case. We have served this neighborhood for over 35 years in English, Spanish, Bengali, Greek and Albanian.
I was delivering for an app. Does that change things?
It can add to them. Depending on how you were engaged and what happened, there may be an avenue connected to the work alongside the claim against the driver. Bring the app records to the free consultation and we will tell you what we see.
My e-bike was over 15 mph, or I was on the sidewalk. Do I still have a case?
You may. Under comparative fault your share of the blame reduces the recovery rather than ending the claim. Decide nothing before someone who does this for a living looks at it.
My battery caught fire. Who is responsible?
That is a product case against whoever made or sold the battery, charger or bike, and it is proven with the equipment itself. Keep everything you safely can, along with any receipts or order history, and call us.

This was the most carefree situation. The office was very supportive. I had a public balance with another entity and the lawyer handled it while negotiating a final payment of substantially less than what was being asked of me. Thank guys you all are awesome.
