The One Rule Every Injured Rider Needs to Know

Here is the rule that surprises almost every motorcyclist we meet: New York's no-fault insurance does not cover you. The no-fault system that automatically pays medical bills and lost wages for people in cars — and for pedestrians and bicyclists — leaves motorcycle operators and their passengers out. You can be carrying full coverage, be completely blameless, and still find that nothing pays your hospital bill on its own.

That is not the end of your case. It changes where the money comes from. Instead of a no-fault claim, your medical bills and your lost income have to be recovered from the driver who caused the crash, through a claim against that driver's liability insurance — and, when the driver has too little coverage or none at all, from the underinsured and uninsured motorist coverage on your own motorcycle policy. Those claims take proof: the police report, the scene, the damage to the bike, the medical records, sometimes an accident reconstruction. They are built, not filed.

There is one place the rule works in a rider's favor. Because motorcyclists sit outside the no-fault system, the "serious injury" threshold that limits what a person in a car can sue for generally does not stand in a rider's way the same manner. Whether that helps in your particular case depends on your facts, and it is one of the first things we look at. Ask us — the conversation is free.

The Law Offices of Evan W. Kohn has represented injured people in the Bronx for more than 35 years. Our office is at 2000 White Plains Road, under the elevated 2/5 train. If you are too hurt to travel, we come to your home or your hospital room. You pay nothing up front, and there is no fee unless we win.

Motorcycle Crashes We Handle

The same handful of driver mistakes put Bronx riders in the hospital again and again. If yours is on this list — or even if it is not — call and we will tell you honestly where you stand.

Left-Turn Collisions

A car turns across your lane at an intersection because the driver "never saw" the bike. It is the most common way riders are hurt, and the turning driver is usually the one who failed to yield.

Lane-Change and Blind-Spot Hits

A driver drifts over on the Bruckner or the Cross Bronx without looking. On four wheels it is a scrape. On two it puts you on the pavement in live traffic.

Doors and Double-Parking

Bronx avenues are lined with double-parked cars and delivery vans. A door swung open, or a van pulling out of a lane it should not be in, leaves a rider nowhere to go.

Road Defects and Potholes

A crater, a sunken utility cut, or loose steel plate can throw a bike down. Claims against the City require written notice long before the crash, so these cases have to be investigated fast.

Hit-and-Run Riders

Drivers leave the scene far too often here. Even when the car is never found, the uninsured motorist coverage on your own policy — or a state fund — may still stand behind your claim.

Injured Passengers

A passenger on a motorcycle almost never shares the blame for a crash. You can bring a claim regardless of which driver was at fault, including against the rider you were with.

What To Do

After a Motorcycle Crash in the Bronx

  • Get checked by a doctor the same day, even if you walked away. Road-rash and adrenaline hide fractures and head injuries.
  • Make sure the police come and a report is filed. Do not let the driver talk you into "handling it between us."
  • Photograph everything: the car, the bike, the skid marks, the lane, the light, your gear, your injuries.
  • Get the driver's license, plate and insurance card, and the phone number of anyone who saw it.
  • Keep your helmet and your damaged gear. They are evidence of the force of the impact.
  • Call us before you give any statement to the driver's insurance company. Their job is to pay you less.

Common Questions From Riders

I was riding without full coverage. Do I still have a case?
Usually yes. Your own coverage does not decide whether the driver who hit you is responsible. It affects which of your own benefits are available, which is exactly the kind of thing we sort out for free before you commit to anything.
Who pays my hospital bills while the case is going on?
Because no-fault does not cover motorcyclists, this is the first thing we work on. Depending on your situation that can mean your health insurance, Medicaid or Medicare, your own policy's optional medical coverage, or arrangements with treating doctors. Tell us what you have and we will map it out.
I was not wearing a helmet. Does that end my case?
New York requires helmets for riders and passengers, and not wearing one can be raised against you — but it does not erase a case. New York's comparative-fault rule lets you recover even when part of the blame is yours; your share reduces the amount rather than closing the door.
The driver says I was speeding. What now?
Drivers say that in almost every motorcycle case. It is a claim, not a finding. The police report, the physical evidence and, where it matters, a reconstruction are what answer it — and gathering that is our job, not yours.
How long do I have to bring a claim?
In New York the general deadline for an injury claim is three years, but shorter clocks apply in specific situations — most sharply when a city or transit vehicle is involved, where written notice can be due within 90 days. Do not measure your own deadline. Call and we will tell you which one governs your case.
